The gay-marriage ban put in place by Proposition 8 in California will remain as Judge Walker Vaughn’s decision to overturn it is appealed.

The three-judge panel on the appeals court said they wanted to examine the constitutionality of the ban, according to the Associated Press. The court will hear oral arguments on the case starting in December. A different panel of judges will decide the constitutionality of Proposition 8. Judge Vaughn had ordered that state officials stop imposing the ban, and same-sex weddings were to begin on Wednesday. He had ruled earlier this month that a gay-marriage ban violated equal protection and due process rights.

Currently, gay marriage is legal in Connecticut, Iowa, Massachusetts, New Hampshire, Vermont and Washington, D.C.
